Hi, my GF's son has bought a new build house, part of his decision to buy this certain house was that the combi boiler was in the garage and out of site, he has also paid for an upgrade to his kitchen. His house is finished and he goes to complete tomorrow, however, the company have put the boiler in his kitchen, where he didn't want it and he's not been informed about it, and he isn't happy about it, as, like i said, this was part of the reason he paid extra for this house over the other 3 bed detatched available.
We have a copy of the plans, where the boiler is placed in the garage, the sheet also has a disclaimer saying that some things can be subject to change. Our argument is that he's paid for the upgrade on his kitchen thinking that the boiler won't be there, as, in the showhouse, the boiler is in the garage, and at no point has he been told that the boiler was being put in the kitchen, he only found out after going round there to measure his floors. The plans we have for his house they say should have been changed previously.
So where do we stand? We have phoned the housing company and asked for a refund on his upgrade at least.
Dec 12, at PM 2. New guidelines that boilers must be in the kitchen? May or may not be true, but I would question that for a start. Even if there is a "guideline", that doesn't make the guideline a law or statutory requirement.

Things may well be "subject to change", but they are also subject to your agreement, it's not carte blanche for them to do what the hell they want. Dec 12, at PM 3. Just had a brand new combi boiler installed to replace the prvious one that did not provide hot water, only heating. The corgi guy just put it in the garage where the old one was.

Dec 12, at PM 4. I imagine that 'subject to change' only applies if they check it with you first. They're not free to remove one of the walls from the design without asking you, so why would they think they can move the fixtures around? Seems to be their mistake so I assume he'd be within his rights demanding they refit it to the specs he requested.
I suppose he could refuse to pay until they've done it, but it seems a bit extreme for a fairly minor issue. Presumably thats what they're hoping he'll think though.
Dec 12, at PM 5. Don't think its true about new rules regarding boilers in the kitchen. I'm in the process of buying a new house and the boiler has just been installed in an airing cupboard upstairs.
